1. Introduction
Welcome to Boostak.com, a platform owned and operated by Boostak Technologies Ltd.
These Terms & Conditions (“Terms”) govern your access and use of the Boostak platform, including the website, mobile interfaces, booking services, talent profiles, payment services, and any related features (collectively, the “Services”).
By accessing or using the Services, you agree to be legally bound by these Terms. If you do not agree, please do not use the platform.
2. Definitions
- “Company”, “We”, “Us”, “Our” – Boostak Technologies Ltd.
- “User” – any person accessing the platform, including talents, event organizers, clients, agencies, or visitors.
- “Talent” – any musician, instrumentalist, performer, DJ, or creative professional offering booking services through Boostak.
- “Organizer/Client” – any individual or entity booking a talent through the platform.
- “Booking” – a confirmed request by a client to hire a talent for an event or engagement.
- “Service Fee” – any commission, convenience fee, or platform charge applied by Boostak.
- “Payment Partner” – Paystack or any other third-party payment provider used by the platform.
3. Eligibility
To use Boostak:
- You must be at least 18 years old.
- You must provide accurate and verifiable information.
- Talents must be legally permitted to work and receive payment in Ghana or their country of residence.
We reserve the right to decline or terminate access for any User at our discretion.
4. User Accounts
4.1 Registration
Users must create an account using accurate personal or business information.
Talent profiles must include correct descriptions, availability schedules, and pricing.
4.2 Account Security
You are responsible for maintaining the confidentiality of your login details.
Any activity under your account will be deemed to originate from you.
Boostak is not liable for unauthorized access resulting from your negligence.
5. Platform Role & Responsibilities
Boostak Technologies Ltd:
- provides a digital platform that connects clients with talents.
- is not a party to any contract between a talent and client.
- does not guarantee performance, punctuality, skill level, or conduct of any talent.
- does not guarantee payment discipline or event quality from clients.
Boostak is a booking facilitator, not an employer, agency, or talent manager.
6. Bookings
6.1 Booking Process
- Clients select a talent, choose a date/time, and complete the required form.
- Talents receive booking notifications through email or dashboard.
- A booking is only considered confirmed when the required payment is completed.
6.2 Talent Responsibilities
Talents must:
- honour confirmed bookings
- arrive on time
- provide professional conduct
- update availability calendars
- set accurate pricing
6.3 Client Responsibilities
Clients must:
- provide accurate event details
- ensure safety and suitable environment for performances
- pay all required fees
- communicate changes in advance
7. Pricing, Payments & Commissions
7.1 Platform Fees
Boostak applies a service fee or commission on each confirmed booking.
The applicable rate will be displayed during checkout.
7.2 Payment Methods
Payments are processed through Paystack, including:
- Mobile Money (MoMo)
- Card payments
- Bank transfers
- Paystack balance (if applicable)
7.3 Manual Payouts to Talents
Boostak may use:
- Paystack Transfers
- Bank transfers
- Mobile Money transfers
- Manual settlement (where applicable)
Transfer fees charged by Paystack or financial institutions may apply and are deductible from payouts.
7.4 Payout Schedule
Payouts to talents may be:
- Immediate,
- Daily,
- Weekly, or
- After event confirmation,
depending on Boostak’s operational policy.
8. Cancellations & Refunds
8.1 Client Cancellations
Refunds vary based on the time remaining before the event:
- More than 7 days → 80% refund
- 3–7 days → 50% refund
- Less than 3 days → No refund
Service fees are non-refundable.
8.2 Talent Cancellations
If a talent cancels a confirmed booking:
- The client receives a full refund
- Boostak may suspend or remove the talent from the platform
- Repeated cancellations may lead to permanent account removal
8.3 Event Cancellations by Boostak
Boostak may cancel bookings for security, fraud, or policy violations.
Refund decisions will be made on a case-by-case basis.
9. User Conduct
Users must not:
- upload false information
- engage in fraud
- misuse the platform
- harass or abuse talents or clients
- violate any applicable laws
We reserve the right to suspend or terminate accounts that violate these rules.
10. Intellectual Property
All content on Boostak—including trademarks, logos, design elements, texts, and software—is the exclusive property of Boostak Technologies Ltd.
Users may not reproduce, republish, or exploit any platform materials without written permission.
11. Privacy & Data Protection
Boostak collects and processes personal data according to our Privacy Policy, in compliance with:
- The Ghana Data Protection Act, 2012 (Act 843)
- Applicable international data laws
By using the platform, you consent to our data practices.
12. Limitation of Liability
Boostak Technologies Ltd is not liable for:
- disputes between talents and clients
- damaged equipment or property
- loss of income, profits, or opportunities
- delays or cancellations beyond our control
- platform downtime or technical errors
Our liability is limited to the amount of service fees paid to us for the booking in question.
13. Dispute Resolution
Disputes must first be reported to Boostak Support for internal resolution.
If unresolved, disputes will be settled under the laws of the Republic of Ghana, through:
- Mediation, and if necessary
- Arbitration under Ghanaian arbitration laws
The courts of Ghana have exclusive jurisdiction.
14. Modifications to Terms
Boostak may update these Terms at any time. Continued use of the platform indicates acceptance of all updates.
